Terms & Conditions

1. Definitions

i) The "Buyer" means the person who buys or agrees to buy Goods from the Seller.
ii) The "Seller" means Forest Architectural Supplies Limited, registered offices Unit 3, The Maltsters, Wetmore Road, Burton-upon-Trent, Staffordshire, DE14 1LS.
iii) "Terms and Conditions" means the Terms and Conditions of Sale set out in this document and any special conditions agreed in writing by the Seller.
iv) “Order” means the contract between the Seller and the Buyer for the sale and purchase of Goods in accordance with these Terms and Conditions.
v) “Goods” means the goods (or any part of them) set out in the Order.
vi) A reference to writing or written includes faxes and e-mails.

2. Contract Details

i) These Terms and Conditions govern the sale of Goods by the Seller to the Buyer. These Terms and Conditions constitute the entire and only agreement between the parties in relation there to. The Seller’s acceptance of the Order by delivery of the Goods constitutes a legally binding contract between the parties on these Terms and Conditions.
ii) All orders placed by the Buyer are on the basis of these Terms and Conditions and are subject to acceptance by the Seller by delivery of the Goods to the Buyer at which point a legally binding contract is constituted between the parties. The processing of payment and acknowledgment of the Buyer’s Order does not constitute legal acceptance of the Order.
iii) These Terms and Conditions supersede all previous terms and conditions issued by the Seller and the Buyer agrees to be governed by them in all matters arising from the purchase of Goods from the Seller.

3. Prices and Ordering

i) Unless otherwise stated all prices are exclusive of VAT, delivery, insurance and installation.
ii) The price payable by the Customer will be the price at the date of the order.
iii) The description and price of the goods you order will be as shown on our website at the time you place your order.
iv) No contract exists between the Customer and Forest Architectural Supplies Limited for the sale of any goods until we have received your order and accepted it (which we may do at our discretion).
v) In the event that, after we accept your order, we discover that the goods ordered are unavailable or that there was a pricing error in respect of the goods ordered, we reserve the right not to supply the goods ordered and to offer you a refund or alternative goods.
vi) We have the right to terminate the contract if the price of the goods is not received from you in cleared funds.
vii) If after acceptance of your order we discover that the goods are unavailable, we may terminate the contract and refund or re-credit you. 

4. Payment and Delivery

i) If payment is made by credit or debit card, delivery will be made to the statement address of the cardholder.
ii) Any delivery date stated is only an estimate. No liability will be accepted by Forest Architectural Supplies Limited for failure to meet a stated delivery date.
iii) Any claim for damage or loss of the goods during transit must be made in writing:
iv) if a Product is damaged, within 72 hours of delivery.
v) if a Product has been lost, within 48 hours of delivery.
vi) Forest Architectural Supplies Limited are not liable for any claims outside the above time limits.
vii) Payment for the goods can be made by any method shown on our website at the time you place your order.
viii) Upon receipt of your order you will be asked to sign for the goods received. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the time of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.

5. Consumer Rights

i) If you are a consumer (a private person buying for their personal use) then you may cancel your purchase at any time within 7 days of receipt and we will give you a refund of the Price Paid within 30 days. You must inform Forest Architectural Supplies Limited in writing (Notification by phone is not sufficient) and return the goods to us immediately and in the same condition you received them.
ii) The customer will be responsible for returning the goods to Forest Architectural Supplies Limited at their own cost.
iii) If the customer does not return the goods as required, Forest Architectural Supplies Limited may charge you a sum not exceeding the direct costs of recovering the goods.

6. Guarantee

i) All goods are supplied with manufacturer warranties and are guaranteed to be free of material defect or faulty workmanship within the warranty period. That period starts from the date the goods are received.
ii) If no warranty period is stated it is assumed to be 14 days.
ii) The Customer should return the Product in its original packaging to Forest Architectural Suppplies Limited at the address above.
iv) Prior authorisation must be obtained for any returns by contacting Forest Architectural Supplies Limited and obtaining an RMA number.
v) If any item is returned which is found not to be faulty, then a charge will be made for return carriage insurance and administration.
vi) This guarantee does not affect your statutory rights as a consumer. 

7. Limitation of Liability

i) Forest Architectural Supplies Limited shall not be liable for any financial consequential indirect or other losses suffered by the Customer or any third party.
ii) If you are a business customer, Forest Architectural Supplies Limited shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

8. Data Protection

i) Forest Architectural Supplies Limited will take all reasonable precautions to keep the details of your order and payment secure. Unless Forest Architectural Supplies Limited are negligent we will not be liable for unauthorised access to information supplied by you.

9. Uncontrollable Events and Delays

i) In case of delays caused by circumstances beyond the control of Forest Architectural Supplies Limited, we have the right to either suspend delivery or to cancel the contract without liability.

10. Customers Obligations

i) You are responsible for your own choice of Product and the suitability for any particular purpose.
ii) Product images are for illustrative purposes only and may differ from the actual product.

11. Governing Law and Jurisdiction

i) These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
ii) If any part of these Terms and Conditions are found to be invalid or unenforceable by a court the rest are unaffected.
